Do you have an inoperable vehicle on your property that you've been trying to get rid of but can't because you lost the paperwork, or it's too expensive to fix? Is there an inoperable vehicle in your neighborhood creating an eyesore?
We can help! As a public service, the City of Lakeport Community Development Department can arrange to have the vehicle removed from your property absolutely FREE of charge! This service is made possible through funds received from the State of California's Abandoned Vehicle Abatement Program (AVA). Call us and we will take care of all the details. In return, you'll be helping your community by creating a cleaner, safer and more beautiful neighborhood to live in.
The City's AVA program was established in 1995 and is operated under the auspices of the County of Lake Abandoned Vehicle Abatement Service Authority. Since the program started in 1995, the City has successfully abated several hundred nuisance vehicles in our community.
Chapter 8.35 of the Lakeport Municipal Code allows for the abatement, removal and disposal, as public nuisances, of abandoned, wrecked, dismantled or inoperative vehicles or vehicle parts from private property. Section 8.35.020 defines a "nuisance vehicle" as:
Any unlicensed or unregistered, abandoned, wrecked, dismantled or inoperative vehicle located on public or private property which creates a condition tending to reduce property values, promote blight and deterioration, invite plundering, create fire hazards, creates an enticement for children or other individuals to loiter in and around exposing them to potential health and safety hazards, creates a harborage for rodents, insects or vectors; and is potentially dangerous to the public's health, safety, and welfare. Abandoned, wrecked, dismantled or inoperative vehicles which have been issued non-operational certificates from the State Department of Motor Vehicles are considered to be nuisance vehicles because they cannot be legally operated upon a public street or highway.
In addition, Section 8.35.030 A. allows a maximum of one inoperable vehicle on a property provided that such vehicle is completely enclosed within a building in a lawful manner. Although not set forth in the Municipal Code, a nuisance vehicle is generally not subject to abatement by the City if it is stored in a lawful manner behind a legally-constructed fence, gate or wall not less than six feet in height, and where it is not readily visible from the street or other public or private property.
Vehicles removed under these provisions are destroyed or parted out by a dismantler and cannot be made operational again. Written notices and the opportunity to have a hearing are provided prior to taking any such action.
Complaints may be filed with the Community Development Department in person, by mail, telephone, or e-mail.
When making a report, please provide the following information:
- The specific address or location where the vehicle is located
- Description, make and color if known
- Condition of the vehicle (flat tire, missing engine, wrecked, dismantled, etc.)
- Your name, address and phone number. Anonymous complaints will be investigated, but please provide your name and contact information if you would like to be advised of the findings of the investigation.
